Terms and Conditions
Please read these Terms & Conditions (“Terms”) carefully. These Terms, together with our Privacy Policy and any written documentation we provide (proposal, invoice, itinerary, booking confirmation, pre-contractual information required by EU law, and any supplier terms incorporated by reference) form the contract (the “Agreement”) between DRIVUSO SARL, trading as Drivuso (“Drivuso”, “we”, “us”, “our”) and the Trade Partner (“you”, “your”) named on the booking. By placing a booking with us, you confirm you have the authority to bind your organisation to these Terms and to act on behalf of your clients.
Definition
- Agreement: These Terms, plus any written documentation and your booking confirmation.
- Trade Partner: The B2B client contracting with Drivuso (e.g., travel agency, tour operator, concierge/lifestyle company, car club, corporate travel department, or other reseller).
- Traveler(s): The Trade Partner’s end-clients who will receive the travel services.
- Self-Drive Tour: A curated arrangement designed and operated by Drivuso consisting of pre-booked travel services (e.g., car rental, accommodations, experiences, route planning, private transfers) in which Travelers drive a vehicle hired from an independent rental Supplier. No convoy/group driving, racing, or track use.
- Supplier/Service Provider: Any third party providing services (e.g., car rental company, hotel, activity provider, transfer operator, insurer).
- Itinerary: The final written schedule and inclusions issued by Drivuso.
- Package: As defined under Directive (EU) 2015/2302 and the French Code du tourisme.
Drivuso designs and sells self-drive tour arrangements in Europe and contracts on your behalf with independent Suppliers. We do not own or operate vehicles, hotels, or airlines. As required by French law, we maintain professional liability insurance and financial protection (garantie financière) for client funds. The details will appear on your invoice, confirmation, and are available on request.
Eligibility
You warrant that you contract as a business and have the authority to bind your organization and your Travelers. Travelers must meet age and licence criteria in all countries visited (and an International Driving Permit where required). Supplier criteria (e.g., licence tenure, credit card, security deposit) also apply. You ensure all Traveler information provided to us is true, current, and complete.
Variation of Terms
We may amend these Terms from time to time. Material changes will be notified. The Terms in force at the time of travel or cancellation apply.
Contract
A binding contract arises when we confirm your booking in writing after receiving the required deposit. Electronic signatures and acceptances are binding.
Prices, Currencies and Taxes
Unless stated otherwise, prices are quoted in EUR. Where applicable, prices include VAT or other taxes for consumer sales; locally payable city/tourist taxes are borne by the Traveler. All quotes provided are based on exchange rates when issued and may vary before confirmation. After confirmation and timely payment, prices will not change except as permitted by law (e.g., tax changes) or by mutual written agreement. All rates we provide are confidential trade rates. You must not disclose our net pricing or itemize our confidential components to Travelers.
Payments
A non-refundable deposit equal to twenty-five (25%) percent of the total price is due upon booking, together with any components requiring full prepayment, such as certain tickets, exclusive experiences, or insurance premiums. The balance is due thirty days (30) prior to the start of services; bookings made within thirty days (30) require payment in full at the time of booking. Payment must be made by the methods indicated on our invoice or at checkout. Failure to pay when due may result in cancellation for non-payment under Clause 9.
Inclusions and Exclusions
Only the items expressly listed in the Itinerary and booking confirmation are included. Unless otherwise stated in writing, air transportation, visas and border formalities, fuel, tolls, vignettes, congestion charges, parking, fines, administrative fees, meals and beverages, personal expenses, optional activities, travel or medical insurance are excluded and payable by the Traveler.
Travel Documents, Entry Requirements, and Travel Insurance
You are responsible for ensuring that Travelers possess valid passports, visas, driving licences, International Driving Permits where required, and all documentation necessary for entry into and travel within the countries included in the Itinerary, as well as for compliance with sanitary, customs, and immigration requirements. Drivuso is not responsible for denial of entry or costs arising from documentation or compliance failures.
You shall require Travelers to maintain from booking until their return comprehensive travel insurance providing cover, at a minimum, for trip cancellation and interruption, medical expenses and emergency evacuation or repatriation, personal liability, and loss or damage to baggage and personal effects. Evidence of adequate cover must be provided upon request. Travelers who choose to travel without adequate insurance do so at their own risk and cost.
Cancellations and Changes by the Trade Partner
Cancellations must be communicated in writing by the Trade Partner. The following charges apply to the total trip price in addition to any non-refundable components:
- The 20% deposit is non-refundable.
- 31–60 days: 50% cancellation fee
- Less than 30 days: 100% cancellation fee (no refund)
Where applicable, we may offer a credit instead of a refund for specific components. Refunds are processed to the original payer within 30 days of confirmation. No refunds are made for unused services after the start of the tour.
Post-booking amendments, including changes to dates, names, or services, are not guaranteed and, if feasible, may be subject to charges together with an administrative fee payable to Drivuso..
Cancellations and Changes by Drivuso
We may cancel or modify arrangements where necessary. If we cancel for reasons other than your breach or force majeure, you may choose an alternative of equivalent or higher value at no additional cost, an alternative of lower value with a refund of the price difference, or a refund of all sums paid to Drivuso for the cancelled services. We are not liable for compensation or ancillary losses where cancellation or material changes result from events beyond our reasonable control that could not be avoided even if all reasonable measures had been taken, including acts of war or terrorism, civil unrest, government action, strikes, epidemics or pandemics and public-health measures, extreme weather or natural disasters, major road closures, or material Supplier failures. In such circumstances, we will provide the assistance required by law where the arrangements constitute a Package.
Fitness to Travel
You are responsible for assessing the Traveler’s fitness to drive and travel. They must comply with health advisories, entry rules, and Supplier protocols (e.g., vaccination or testing requirements).
Car Rental
Vehicles are provided by independent rental Suppliers and are subject to each Supplier’s rental agreement and insurance terms, which govern eligibility, vehicle condition, permitted use, security deposits or card authorizations, damage assessment, and any applicable excess or deductible. Only named and authorized drivers may drive. Road use only is permitted; off-road use, track or closed-road use, racing, towing, speed testing, and any unlawful use are prohibited. Drivers must present a physical licence, passport, or national ID, and a credit card in the driver’s name for the deposit, together with an International Driving Permit where applicable. Certain damages, including to tyres and wheels, windscreens, underbody, vehicle interior, misfuelling or keys, may be excluded from standard cover. Excess-reduction products may be offered by the Supplier, and Travelers may obtain separate vehicle excess insurance if desired. Travelers are responsible for fuel, tolls and vignettes, congestion and parking charges, and for all traffic or administrative fines and associated Supplier administrative fees. In the event of an accident, theft or breakdown, Travelers must follow local law and Supplier instructions, ensure safety, contact emergency services where required, obtain third-party details, refrain from admitting liability, notify the Supplier immediately, and inform Drivuso so that assistance can be coordinated. Cross-border use is permitted only if expressly authorized by the Supplier. Vehicles may be equipped with GPS or telematics for safety, theft prevention, and contractual enforcement. You warrant that you will obtain and document any Traveler consents required for such processing in accordance with applicable data-protection law. Travelers must inspect and document vehicle condition at pickup and return the vehicle on time, with the agreed fuel level, to the agreed location; late returns and relocations may result in additional charges.
Accommodations
Accommodation is provided by independent Suppliers in accordance with their policies and house rules. Star or category ratings are indicative only and may vary by country. Check-in/check-out times, bedding configurations, amenities, facilities, accessibility features and on-site services are determined by the property and may change without notice. Incidentals, resort or service fees and locally imposed tourist or city taxes are payable by the Traveler on site unless expressly included.
For villas and private residences, the Traveler’s right of occupancy is a limited licence and does not create a tenancy. Security deposits, inventory checks, utility or heating surcharges (including pool heating) and additional housekeeping are set by the property and are payable by the Traveler. Occupancy limits, event or party restrictions, noise regulations and neighbour-disturbance rules must be strictly observed; any event, filming or commercial use requires our prior written consent and the owner’s approval and may incur additional fees and insurance. The owner or manager may access the property for reasonable management, maintenance and safety purposes. Breakage or damage is chargeable to the Traveler. If a property becomes unavailable due to sale, withdrawal by the owner, material damage or other circumstances beyond our reasonable control, we will use reasonable efforts to secure comparable accommodation; failing that, our liability is limited to refunding the amounts paid for the unused accommodation component.
Local Experiences and Chauffeur Services
Experiences, activities, guides and private chauffeurs are supplied by independent Suppliers under their terms. Service scope, timings, meeting points, inclusions and safety obligations are as stated in the Supplier confirmation. Chauffeur services are subject to local transport, working-time and road-safety regulations; route selection, waiting time, overtime, additional stops, detours, night-surcharges, tolls, parking and cleaning or damage fees may apply and are payable by the Traveler where not included. Luggage capacity is limited to the vehicle’s design and safety; carriage of hazardous or unlawful items is prohibited. Child seats must be requested in advance and fitted/used in accordance with local law. Smoking, consumption of alcohol or food and standing in the vehicle may be refused or restricted by the Supplier. Neither Drivuso nor the Supplier is liable for missed connections or delays caused by traffic, accidents, weather, road closures or events beyond reasonable control; in such cases reasonable efforts will be made to minimize disruption.
Conduct and Safety
Unsafe, illegal, intoxicated, reckless or harassing conduct is prohibited. Drivuso and Suppliers may refuse or terminate services, without refund, where behavior endangers safety, breaches law or contract, or materially disrupts operations. You are responsible for communicating these obligations to Travelers and ensuring their adherence.
Additional Risks
Self-drive touring involves inherent risks, including but not limited to mountain or coastal roads with limited barriers, varying road surfaces and widths, adverse weather, roadworks and temporary closures, limited visibility, wildlife or livestock on roads, unfamiliar local driving practices, theft or petty crime, and limited access to emergency services in remote areas. Navigation, traffic and route information provided by Drivuso or by devices or applications may be incomplete or inaccurate and does not replace the driver’s obligation to comply with traffic laws, road signage and conditions on the ground. High-performance vehicles may accelerate or brake more rapidly than standard passenger cars and require heightened attention, appropriate following distances and prudent speed. Seatbelts must be worn at all times; driving under the influence of alcohol, drugs or medications that impair driving is strictly prohibited; fatigue management is the driver’s responsibility. By proceeding, you accept and shall procure that Travelers accept these risks to the fullest extent permitted by law; this clause does not exclude liability that cannot be excluded by mandatory law for Drivuso’s proven fault.
Changes on Tour
Local conditions, including weather, road closures, events, and Supplier issues, may necessitate adjustments to routes, timings or services. We will use reasonable efforts to provide comparable alternatives. Such adjustments do not constitute a material change where they do not fundamentally alter the character of the trip and may therefore not be subject to financial compensation.
Optional Activities and Third-Party Services
Optional activities suggested by Drivuso are provided by independent Suppliers under their terms. Your contract for such activities is with the Supplier, and participation is at the Traveler’s risk. Drivuso does not warrant the fitness or safety of optional services not operated by us.
Roadbooks and Driving Guides
Drivuso may provide written and digital roadbooks, country-specific driving guides and navigation data. These materials are licensed only for the named Travelers and service dates on the confirmed booking and may not be shared, reproduced, resold, stored as templates, or incorporated into other trips. The Trade Partner shall pass these restrictions to Travelers and ensure compliance.
The Guides are informational and supplementary; they are not legal advice, a driving course, or a substitute for signage, local law, real-time traffic information, or the driver’s judgment. Routes, conditions, and regulations may change without notice. Travelers must obey local traffic laws at all times and remain responsible for safe vehicle operation, speed selection, spacing, weather precautions and fatigue management. Mapping, POIs and navigation files may rely on third-party platforms subject to their terms; accuracy, availability and continuity are not guaranteed. Where versions are updated, Drivuso will provide the latest edition reasonably available before departure; earlier editions should be discarded.
Personal Belongings
Travelers are responsible at all times for their baggage and personal property. Drivuso and Suppliers are not liable for loss, theft, or damage except to the extent required by law due to proven fault.
EU Package Travel Regulations
Where the arrangements constitute a Package within the meaning of Directive (EU) 2015/2302 and the French Code du tourisme, and unless otherwise agreed in writing, Drivuso acts as organizer for the services it combines and the Trade Partner acts as retailer to the Traveler. Drivuso will provide the statutory standard information form and essential pre-contractual information for the package components we supply; you shall deliver these to Travelers at the point of sale and procure their acceptance of applicable terms, including Supplier rental terms and driving eligibility requirements. Drivuso is responsible, in its capacity as organizer, for the proper performance of the services included in the Package and for providing appropriate assistance if a Traveler is in difficulty, subject to the statutory defenses and limitations where non-performance is attributable to the Traveler, to a third party unconnected with the provision of the services, or to extraordinary circumstances. If you package additional services beyond those supplied by Drivuso, you may become an organizer in whole or in part in respect of the overall package, in which case you assume organizer duties and liabilities in your jurisdiction.
Complaints and Assistance
Operational issues should be raised immediately with Drivuso so that remedial action can be taken. If a matter remains unresolved, you shall submit a written complaint to info@drivuso.com within thirty days of the end of the services, together with reasonable supporting evidence. Drivuso will provide assistance required by applicable law where the arrangements constitute a Package.
Intellectual Property
All itineraries, route designs, roadbooks, navigation files (including GPX/KML), maps, text and copy, supplier curation and operational playbooks, pricing structures, layouts, images and other materials furnished by Drivuso are and remain Drivuso’s exclusive property, with all intellectual-property and database rights reserved. Upon booking confirmation, Drivuso grants the Trade Partner a revocable, non-exclusive, non-transferable licence to use the Drivuso Materials solely to promote, sell and fulfil the confirmed booking and only to the extent necessary for that purpose. The licence does not permit republication, white-labelling, template creation, scraping, disclosure of supplier operating details, or reuse on other trips without Drivuso’s prior written consent.
Data Protection
Each party acts as an independent controller of personal data it processes under this Agreement. You warrant that you have a lawful basis to share Traveler data with Drivuso and with Suppliers, that you have provided all required transparency notices, and that you have obtained any required consents, including for telematics where applicable. Drivuso processes personal data in accordance with the GDPR and French data-protection law and as described in our Privacy Policy. We may share necessary data with Suppliers for the purposes of contract performance, safety, fraud prevention and legal compliance. Each party will cooperate reasonably with the other in relation to bona fide data-subject requests and security incidents, as required by law.
Governing Law and Jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them are governed by French law. The courts of France have exclusive jurisdiction to hear any dispute, without prejudice to mandatory consumer protections owed to Travelers under applicable law.
Severability
If any provision of these Terms is held invalid or unenforceable, the remainder shall continue in full force to the maximum extent permitted by law. This Agreement constitutes the entire agreement between the parties regarding its subject matter and supersedes any prior understandings. You may not assign or transfer your rights or obligations without our prior written consent. Notices must be sent to info@drivuso.com and are deemed received upon acknowledgment by Drivuso. All commercial terms, rates and documentation furnished by Drivuso are confidential and may not be disclosed save as required for performance of the Agreement or by law.
Acceptance
Your booking request, deposit or other payment, or signature constitutes acceptance of these Terms by the Trade Partner, including the obligation to incorporate or pass through to Travelers all relevant obligations and disclosures required for lawful and safe participation in Self-Drive Tours.
